Notice of the Twentieth Annual General Body Meeting

Notice is hereby given that Twentieth Annual General Body Meeting of Navi Mumbai Co-operative Housing Federation Ltd. will be held on SUNDAY, 19th August, 2018 at 10.00 a.m. at Jhulelal Temple Hall, 1st Floor, Plot No.7, Sector 9A, Vashi, Navi Mumbai – 400 703 to transact business as given in the Agenda below:


  1. Welcome Address by the Chairman;
  2. To read and confirm the Minutes of the Nineteenth Annual General Body Meeting held on 17th Sept. 2017;
  3. To receive and adopt the Annual Report of the Federation for the Financial Year 2017-18;
  4. To receive and approve the Audited Statements of Accounts for the Financial Year 2017-18;
  5. To appoint Statutory Auditors for the Financial Year 2018-19 and fix their remuneration;
  6. To discuss and decide on sanction for purchase of about 1000 sq. ft. premises from CIDCO for office;
  7. To approve the Budget for the Financial Year 2018-19;
  8. To consider any other matter with the permission of the Chair.

N. B:

  1. If there is no quorum at the appointed time at 10 a.m., the meeting will be adjourned for half an hour. The meeting will be reconvened at 10.30 am at the same venue on the same day and the business as per the agenda will be transacted irrespective of the quorum.
  2. Members are requested to send their queries, if any, on the Annual Report and Audited Statements of Accounts or on any other matter, in writing, so as to reach the Federation office latest by 12th August, 2018.
  3. All queries should contain name, address, contact number and preferably contact e-mail Id of the sender. All attempts will be made to answer queries during the meeting itself or alternately by mail.
  4. Member Societies are requested to nominate their authorized representative, well in advance but not later than 12st August, 2018, failing which the person who has signed the application for membership to this Federation will be treated as the authorized representative.
  5. Member Societies are requested to clear their dues, if any, towards annual subscription.

Welcome address by the chairman

Dear Members,

At the outset I express on behalf of all the Member Societies, the Managing Committee and on my personal behalf heartfelt condolence on the loss of our General Secretary, Mr. K. Somakumar.  I may be permitted to put on record that we are not only deprived to witness his ever jolly and smiling face due to his sudden premature demise but also the vacuum created in the management, which by no means can be filled up with proper replacement.

It is the responsibility on my part to welcome you all in the AGM of the Federation. You are all aware that though Co-operative Society is a State Subject, on the strength of the 97th amendment of the Constitution of India, Central Government has advised all the State Governments to amend their respective Co-operative Act in consonance with such amendment.

Friends, you are already aware that your Federation’s Chairman, Secretary or any other Board Member generally remains present on all working days from 10.30 am to 2.00 pm to attend to all its Member Societies to resolve their specific problems. Such practice is in operation for a very long time.

Our experience of last two decades gives rise to the basic concept that all the problems of the society are pivoted only on two points namely “IGNORANCE” and/or “EGO”. The 97th amendment has consequently amended Maharashtra Co-operative Societies Act, 1960, and given stress on education of all members of the co-operative societies along with their employees.

As you are aware, as per Section 24A of the Maharashtra Cooperative Societies Act, 1960, it is the duty of every society to impart training to at least 20% of its members every year.

It is now a must for all Co-operative Housing Societies to create Education and Training Fund @ Rs. 10 per Flat/Unit per month; this Fund is to be utilized only for providing education and training to all its members on specified topics and communicate compliance to the Joint Registrar through Annual Report, which is to be submitted within six months from the close of the financial year.

The Commissioner for Co-operation & Registrar of Cooperative Societies has specified five topics for this programme, covering provisions of Act, Rules and Byelaws and their implementation in resolving the common problems of the societies.

Your Federation, by a franchise, is authorized to conduct such training programme and arrange to issue certificate of participation to each participant Society. Each session will be of about 3 hours. Fee for the same has been fixed @ of Rs. 2,000/- per Society for participants up to 10 and Rs. 3,000/-.for more than 10 participants

Consequently, the Federation has decided to extend such facility to all its member societies on any Holiday/Sunday either at their own premises or at joint programme in different Nodes. The societies situated at Vashi may avail the opportunity on  specific Sunday at the ground floor of Lakshdeep Hospital Compound from 10.30 a.m. to 1.30 p.m. with prior appointment.   Now we request you to take the benefit of the same and make this initiative a great success.

Venue for other Nodes is under consideration for finalization.

You are hereby requested to book the seats indicating number of participants and preferable date and place, at the earliest, to avail of the facility on first come first served basis.

Dear Members,

It is with sense of deep grief and sadness that this report is being placed before you. During the year, we lost Mr. K. Somakumar who was the General Secretary since inception of the Federation in the year 1999-2000. His sudden death on 28th October, 2017  left a vacuum which cannot be filled. He was deeply involved in the activities of the Federation and devoted substantial time and energy for the Federation work. Member Societies who used to approach Federation for discussing their society matters will recall the zeal and enthusiasm with which he used to address their issues and guide them always with a smiling face. It will be virtually impossible to find another person who is equally committed to co-operative society matters.

The year 2017-18 has seen two major legislations coming into effect, namely: Real Estate (Regulation & Development) Act, 2016 (RERA) and Goods and Services Tax Act, 2016. Both these Acts were waiting for finalization and notifications which were getting delayed due to various reasons. The Appellate Authority has been constituted under RERA and is learnt to have already taken few major and landmark decisions. GST has been implemented from July 2017 but is faced with some teething problems. But as per some experts, the same will be ironed out soon.

As all of you may be aware, your Federation along with other leading Federations of Maharashtra has vigorously pursued the issue of formulation of separate Chapter for Housing Societies and also amendment to Model Bye-Laws of Co-operative Housing Societies with appropriate authorities. Insofar as changes to Bye-Laws, your Federation was actively involved with the official meetings of the Committee formed by the Commissioner for Co-operation and Registrar of Co-operative Societies (CCRCS) to suggest the necessary changes. While we are assured that recommendations would be forwarded to the CCRCS for further action, we have to regretfully state that there has been no progress in this regard. As for separate Chapter for Housing Societies, it appears that this has encountered, as usual, with some procedural and bureaucratic hurdles. Insofar as exempting small societies from the purview of State Co-operative Election Authority (SCEA) for conducting their elections is concerned, we learn that even though the suggestion has received Ministerial level approval, this proposal again has faced some legal hurdle and there is no concrete progress in the matter.

Your Federation has been constantly interacting with other leading Federations of Maharashtra like Mumbai, Thane, Pune, Maharashtra State Co-operative Housing Federation and also Yashwant rao Chavan Pratishtan, Pune, an active NGO in the field of Housing Cooperative Movement in Maharashtra which has been serving immensely for the housing sector by roping most of the Housing Federations for  getting their suggestions, inputs and legal advice for onward interaction with Government of Maharashtra and has been assisting in amendment of Bye-laws from time to time.  We are happy to register that the services of Navi Mumbai Cooperative Housing Federation have been widely acknowledged and appreciated by Yeshwantrao Chavan Pratishtan, Pune.

After serious and persistent efforts, Writ Petition against CIDCO regarding collection of Transfer Charges has been filed in Bombay High Court. Matter was listed for hearing on 23rd April 2018 but since CIDCO did not attend the hearing the matter was adjourned to 19th July, 2018.  On the said date when the matter was called out the Court, being busy with part heard cases, mentioned that it will give next date for the hearing soon. We are hopeful of getting  favorable order through the Court.

The Board of Directors met 12 times during the year as per statutory requirements. During the year under review 103 new members were admitted to the Federation. Total membership of the Federation stood at 2552 as on 31st March 2018.

After continuous follow-up, the issue of appointment of Recovery Officer for Navi Mumbai finally got decided with the appointment of 4 (Four) Recovery Officers.   Interested Societies may approach Federation Office for details in this regard.

Member societies are requested to note that in compliance with the national policy to minimize the use of paper, it is proposed to circulate the Notice for AGM through website of the Federation ( Member societies are requested to register their contact e-mail Id with the office of the Federation with immediate effect, if they are interested to enjoy the same facility of service through their registered e-mail id too.
